Patient Terms for GetClinic-hosted Clinic video, audio and online meetings, whether free or paid

If a Clinic or healthcare professional provides medical advice, diagnosis, treatment planning, prescribing, clinical assessment or another healthcare service during a Session, the Clinic/healthcare professional is responsible for the healthcare service and for complying with applicable telehealth, professional-licensing, consent, recordkeeping and other healthcare laws.

1. Scope and Relationship to Other Terms

These Teleconsultation & Meeting Platform Terms (the “Session Terms”) govern a Patient’s use of GetClinic-hosted or GetClinic-enabled video, audio, messaging-assisted or similar real-time meeting functionality with a Clinic, healthcare professional, Clinic coordinator, interpreter or other authorized participant (a “Session”).

These Session Terms apply whether the Session is free/non-paid or paid. GetClinic meeting infrastructure may be used for Patient-Clinic communications that do not involve a paid consultation or a Treatment Booking, including introductory calls, coordinator meetings, scheduling, document collection, package or price discussion, travel/logistics coordination, administrative follow-up and similar Patient-Clinic purposes.

A free or non-paid Session can still become a Medical Teleconsultation if clinical care is actually provided. Conversely, charging a fee does not by itself determine whether a Session is clinical; the substance of the service and applicable law control.

These Session Terms supplement the then-current GetClinic Patient Marketplace Terms of Service (the “Patient Terms”). The Patient Terms continue to govern your general use of GetClinic, including the liability, consumer-rights, dispute-resolution, governing-law and general provisions that are not replaced here.

Transaction-specific Session disclosures control the specific Session for matters they expressly address, including Session date/time, Session type, Clinic, participant, fee, payee, cancellation/no-show terms, recording status and other Session-specific information. Clinic healthcare documents govern healthcare, clinical consent and medical care between you and the Clinic. Privacy notices govern data processing and do not become contractual consent merely because you accept these Session Terms.

Nothing in these Session Terms reduces a mandatory Patient right that applicable law does not permit to be waived.

2. Definitions

“Session”A scheduled or on-demand video, audio or similar online meeting using GetClinic technology between a Patient and one or more Clinic-side participants.
“Non-Clinical Meeting”A Session intended for introductory, administrative, logistical, informational, coordination, commercial or other non-clinical purposes and not intended to provide diagnosis, prescribing, treatment decisions or other clinical care.
“Medical Teleconsultation”A Session in which a Clinic or appropriately qualified healthcare professional provides or intends to provide a healthcare service remotely, such as clinical assessment, medical advice, diagnosis, treatment planning, prescribing where lawful, or other regulated healthcare activity.
“Clinic”The independent healthcare provider selected or engaged by the Patient through GetClinic.
“Clinic Consultation Charge”A separately disclosed amount charged by the Clinic for a consultation provided by the Clinic or its healthcare professional, including a remote consultation using GetClinic technology.
“GetClinic Fee”Any fee charged directly by GetClinic for GetClinic’s own separately identified service, if applicable.
“Session Disclosure”The transaction-specific information shown for a Session, including the session-specific disclosure fields shown before the Session where applicable.

3. GetClinic Provides Infrastructure - Not Healthcare

GetClinic provides technology that may enable scheduling, invitations, audio/video connectivity, messaging, document exchange, payment interfaces, reminders, technical logs and related administrative workflows.

Use of the meeting infrastructure is not conditioned on a Patient making a payment unless the specific Session is expressly offered as a paid service. A Clinic may use the infrastructure for free Patient communications, coordination, evaluation or follow-up where permitted by the product and applicable law.

GetClinic is not a hospital, clinic, physician, dentist, healthcare professional, telehealth provider, prescribing professional or emergency service. GetClinic does not diagnose, prescribe, determine medical suitability, select treatment, supervise the Clinic’s healthcare professionals or provide clinical aftercare.

Use of GetClinic meeting technology does not create a doctor-patient, dentist-patient or other healthcare-provider relationship between you and GetClinic. A healthcare relationship may arise separately between you and the Clinic or healthcare professional under applicable law.

4. Session Classification - Clinical or Non-Clinical

A Session may be presented as a Non-Clinical Meeting or a Medical Teleconsultation. The classification is intended to help explain the expected purpose, but it does not override applicable law or the actual conduct of the participants.

A Non-Clinical Meeting may include matters such as introductory discussion, treatment-process information, scheduling, package explanation, travel/logistics, administrative case coordination, payment or booking questions, document collection, interpreter coordination, or communication with non-clinical Clinic personnel.

A Medical Teleconsultation may include clinical assessment, discussion of symptoms or history, medical advice, diagnosis, treatment planning, discussion of risks/alternatives, prescribing where legally permitted, or another healthcare service provided remotely by an appropriately qualified professional.

Substance controls. A Session does not cease to be a regulated medical service merely because it was labelled “meeting”, “consultation”, “intro call” or another non-clinical term. If clinical care is actually provided, the Clinic and professional remain responsible for the legal obligations that apply to that care.

Likewise, the presence of a doctor or other healthcare professional does not automatically mean that every Session is a Medical Teleconsultation if the Session remains purely introductory or administrative.

5. Clinic and Healthcare Professional Responsibility

The Clinic is responsible for the conduct and healthcare services of its healthcare professionals and other personnel participating in a Session, including identity, credentials, professional authorization, scope of practice, supervision, standard of care, informed consent, privacy/confidentiality, documentation, prescribing and follow-up obligations.

Where applicable law regulates remote healthcare based on the Patient’s location, the professional’s location, the Clinic’s location, or another jurisdictional connection, the Clinic is responsible for determining whether the Medical Teleconsultation may lawfully occur and what conditions apply.

GetClinic may restrict, disable, reschedule or decline to support a Medical Teleconsultation where a legal, regulatory, safety, licensing, privacy, sanctions, security or product-support requirement is unresolved. A booking confirmation or technical ability to connect does not constitute a legal opinion that remote clinical care is permitted.

6. Your Location and Identity

For a Medical Teleconsultation, the Clinic or GetClinic may ask you to confirm your identity, current physical location, contact details, emergency contact or other information reasonably necessary for the Clinic to provide remote care lawfully and safely.

You must provide location and identity information accurately where requested. If you move to another country, state, province or other jurisdiction before or during the Session, you should tell the Clinic because the change may affect whether the professional may continue providing clinical care.

A Clinic may pause, convert to a Non-Clinical Meeting, require an in-person visit, or end a Medical Teleconsultation if it cannot verify information required to provide the service lawfully or safely.

7. Teleconsultation Limitations and In-Person Care

Remote care has limitations. A healthcare professional may be unable to perform a complete physical examination, obtain vital signs, conduct imaging or laboratory testing, or observe information that would be available in person.

The Clinic may determine that remote consultation is insufficient and require an in-person examination, additional testing, records, photographs, imaging, local medical evaluation or another step before giving a diagnosis, prescription, final Treatment plan, medical approval or other clinical decision.

A Session does not guarantee that the Clinic will accept you for Treatment, confirm a previously discussed procedure, issue a prescription, provide a final diagnosis, maintain a quoted Treatment Price, or determine that travel or Treatment is appropriate.

8. Medical Emergencies

GetClinic is not an emergency service and Sessions are not intended for emergency triage or time-critical care. Do not wait for a scheduled Session or send a GetClinic message if you believe you are experiencing a medical emergency.

If you have symptoms that may require urgent or emergency treatment, contact the appropriate local emergency service or local healthcare provider immediately. A Clinic participant may direct you to local emergency care if an urgent issue becomes apparent during a Session.

9. Prescriptions, Medications and Medical Documents

GetClinic does not prescribe or dispense medication. A Clinic or healthcare professional may prescribe only where legally permitted and clinically appropriate. Cross-border, controlled-substance, identity-verification and local pharmacy rules may prevent or limit remote prescribing.

GetClinic does not guarantee that a prescription issued in one jurisdiction will be valid, accepted or fillable in another jurisdiction.

Documents displayed, uploaded or transmitted through GetClinic do not become GetClinic medical advice. The Clinic is responsible for clinical interpretation and for deciding whether additional records or verification are required.

10. Patient Information and Accuracy

If a Session involves healthcare evaluation, you should provide accurate and complete information to the Clinic to the best of your knowledge, including relevant symptoms, medical history, medications, allergies, prior procedures, pregnancy status where relevant, test results and material changes that occur before the Session.

Knowingly false, misleading or materially incomplete information can affect safety, clinical assessment, Treatment scope, pricing assumptions, medical approval and the Clinic’s ability to provide remote care. Nothing in this Section excuses the Clinic from performing an appropriate professional assessment.

11. Participants, Companions, Interpreters and Privacy

A Session may include the Patient, Clinic personnel, healthcare professionals, authorized coordinators, interpreters, support personnel or other participants reasonably connected with the Session. Where law requires disclosure or consent for a participant, the Clinic is responsible for satisfying that requirement for its participants.

You may allow a family member, companion, interpreter or legally authorized representative to participate where the Clinic permits and applicable law allows. You are responsible for ensuring that a person you invite is authorized to hear information you choose to discuss.

For privacy and safety, use a reasonably private location where possible, protect your device and account credentials, and avoid joining through a shared/public device or network if doing so would expose sensitive information.

12. Language, Translation and Accessibility

The Clinic is responsible for providing medically appropriate language support or qualified interpretation where required for informed consent or safe healthcare. GetClinic may provide convenience translation, captioning or communication tools where available, but automated or general-purpose translation may contain errors.

Do not rely solely on automated translation for urgent symptoms, medication instructions, material clinical risks or informed-consent information unless the Clinic confirms the method is appropriate for the healthcare interaction.

If you need an accessibility accommodation or interpreter, tell the Clinic or GetClinic support as early as practicable so available arrangements can be considered.

13. Recording, Screenshots, Transcription and AI-Assisted Features

GetClinic will not intentionally record the audio or video content of a Medical Teleconsultation without an applicable lawful basis and any notice, consent, authorization or permission required by law. Where separate permission is required, a general acceptance of these Session Terms is not that permission.

Recording is OFF by default. GetClinic must not enable an audio/video recording feature for a Session unless the applicable recording-law and professional-rule position has been cleared for the relevant Session/jurisdictions and the product is configured to obtain and evidence every required notice, consent, authorization or other permission. If the legal position is unknown, disputed or uncleared, recording remains disabled.

A technical recording toggle, Clinic request, Patient request or participant consent obtained in only one jurisdiction is not, by itself, legal clearance for a cross-border Session.

The Clinic may create clinical notes or medical records as required or permitted by law. Clinical note-taking is separate from making an audio/video recording of the Session.

You and Clinic participants must not record, screenshot, rebroadcast or otherwise capture Session content unless all permissions required by applicable law and the relevant Clinic rules have been obtained.

If GetClinic offers transcription, summarization, translation or other AI-assisted Session features, the feature may be subject to an additional notice or control. Such tools are assistive technology and do not replace the Clinic’s responsibility to review clinical information and make healthcare decisions.

Live transcript translation. Where GetClinic makes live transcript translation available for a Session, the feature is powered by an artificial-intelligence service, and the transcript text is processed for that purpose by GetClinic’s AI provider outside the EEA and the United Kingdom, currently in the United States. GetClinic must not enable the feature for a Session unless every participant is told, before the Session begins, that an AI system will process what is said. If that notice cannot be given, the feature remains disabled. The feature does not create an audio or video recording of the Session, and the recording rules above continue to apply separately. The AI provider is identified in GetClinic’s subprocessor list.

GetClinic does not authorize service providers acting on its behalf to use private Patient health information or private Session content for their own advertising or unrelated general-purpose model training.

14. Health Information and Privacy

Sessions may involve sensitive health information. GetClinic’s handling of health information is described in the Patient Privacy Policy and Health Data Privacy & Sharing Notice. Those notices explain matters including progressive disclosure to selected Clinics, service providers, security, retention, international transfers and applicable privacy rights.

When you choose or engage a Clinic and use a Session, GetClinic may transmit information reasonably necessary for the requested Session, evaluation, Booking, payment, safety, support or legal purpose, subject to applicable law and any separate permission required.

Once the selected Clinic receives information for its own healthcare purposes, the Clinic may become independently responsible for that information under healthcare and privacy law. GetClinic does not control the Clinic’s medical-record retention or independent healthcare privacy duties.

Acceptance of these Session Terms is not blanket consent to sell health information, use private health information for targeted advertising, use medical uploads for promotion, record a Session, or disclose your entire medical file to every Clinic.

15. Technical Requirements and Session Quality

You are responsible for having a compatible device, adequate internet connection, working camera/microphone where required, and any permissions needed for the GetClinic application or browser to access those functions.

Internet, device, browser, electricity, telecom-provider and third-party outages can affect audio/video quality. GetClinic does not guarantee that every Session will be uninterrupted or clinically adequate for the intended purpose.

If a technical failure occurs, follow the available reconnect/support instructions. The Clinic may continue through another lawful and approved communication method, reschedule, or determine that the Session cannot safely continue remotely.

16. Scheduling, Timing and Attendance

The Session date, time and time-zone information shown in the Session Disclosure or Booking record govern the scheduled Session. Because GetClinic is used internationally, you should verify the displayed time and your local time before the Session.

You should join on time and remain reasonably available for the scheduled Session. Clinic delays can occur in healthcare settings. A delay does not automatically mean the Session has been cancelled, but applicable transaction terms and mandatory law continue to apply.

If you cannot attend, use the available cancellation or rescheduling route as soon as reasonably possible. Any monetary Patient cancellation or no-show consequence applies only to the extent it was disclosed before the Patient became bound or paid and is lawful. A free Session may still be subject to reasonable scheduling or rescheduling procedures, but use of a free Session does not itself create a monetary charge.

17. Fees, Payee and Payment Disclosure

A Session may be free/non-paid or paid. GetClinic may provide the same meeting infrastructure for non-paid Patient-Clinic purposes, and scheduling, joining or completing a free Session does not itself create a payment obligation. Where payment is required, GetClinic will display the material payment information available through the relevant checkout, including the amount, currency, the nature of the charge, Payment Beneficiary or Payee, Payment Processor or route where applicable, and the relevant cancellation/no-show terms.

For a free Session, payment-specific provisions in these Session Terms do not create a Clinic Consultation Charge, GetClinic Fee, cancellation charge or no-show charge. If a later Session or service is offered for payment, the applicable price and payment terms must be separately disclosed before the Patient becomes bound or pays.

A Clinic Consultation Charge is a Clinic charge for a consultation provided by the Clinic or its healthcare professional. It is not automatically a GetClinic Fee merely because GetClinic technology processes or displays the payment.

Consistent with Section 30 of the Patient Marketplace Terms, GetClinic does not separately charge Patients merely for ordinary marketplace access or ordinary Patient-Clinic meeting infrastructure. If GetClinic ever charges a separate GetClinic Fee for a genuinely separate, separately contracted GetClinic consumer service, that fee must be separately identified before payment. GetClinic will not relabel a Clinic Consultation Charge as GetClinic revenue or vice versa.

A Clinic Consultation Charge is separate from a Clinic Booking Deposit. It is credited toward a later Treatment Price only if the Clinic Offer or other transaction-specific terms expressly say so.

18. Cancellations, Rescheduling, No-Shows and Refunds

The cancellation, rescheduling and no-show terms applicable to a paid Session must be shown before payment. A Patient cancellation or no-show charge cannot be created after payment if it was not previously disclosed and lawfully applicable. A free Session does not generate a payment-based cancellation or no-show charge unless a separate charge was lawfully disclosed and accepted before it could apply.

Clinic cancellation. If the Clinic cancels a paid consultation before the consultation is provided, the unused Clinic Consultation Charge must be refunded in full unless you voluntarily accept a rescheduled consultation or another lawful alternative.

Completed consultation. If a separately disclosed and lawful paid consultation has actually been provided, the Clinic Consultation Charge may remain payable even if the Clinic later determines that you are not medically suitable for the proposed Treatment, unless the applicable transaction terms or mandatory law require a refund.

Technical failure. If GetClinic’s technology materially prevents a Session from being provided, GetClinic will use reasonable efforts to restore access or support rescheduling. For a free Session, there is no Session fee to refund. Any refund of a Clinic Consultation Charge for a paid Session remains governed by the applicable transaction terms, whether the Clinic service was actually provided, and mandatory law; where GetClinic or its PSP controls the relevant payment, GetClinic may initiate or facilitate a refund that is due. Any genuinely separate GetClinic Fee remains subject to Section 30 of the Patient Terms and mandatory consumer law.

The 72-hour Treatment Booking Deposit rule in GetClinic’s Booking & Deposit Terms is not automatically a cancellation rule for every standalone consultation. A consultation uses the consultation-specific cancellation/no-show terms displayed before payment, subject to mandatory law.

19. Medical Rejection and Treatment Decisions After a Session

A Medical Teleconsultation may result in the Clinic requesting more information, approving a proposed Treatment, conditionally approving it, rejecting it as medically unsuitable, recommending a different Treatment, or declining to make a final decision remotely.

A medical-rejection decision concerning a later Treatment Booking does not retroactively convert a completed, separately disclosed and lawfully charged consultation into an unused Booking Deposit. The refund rules for any Treatment Booking Deposit remain separate and are governed by the applicable Booking & Deposit Terms and Refund & Cancellation Policy.

20. Consumer Cancellation and Early Performance Rights

Depending on your country and the nature of the Session, statutory cancellation or withdrawal rights may apply to GetClinic’s technology service, a Clinic healthcare service, or both. Healthcare services and fully performed digital/services contracts may be treated differently under different consumer laws.

Where applicable law permits performance to begin during a statutory withdrawal period only after your express request, acknowledgment or consent, GetClinic or the Clinic may ask for that separate confirmation before the Session begins. Nothing in these Session Terms waives a mandatory consumer right that cannot lawfully be waived.

21. Minors and Authorized Representatives

A Patient must generally be at least 18 years old to create and control a GetClinic Patient account in their own name. A parent, legal guardian or other authorized representative may arrange or participate in a Session for another person where permitted by applicable law and accepted by the Clinic.

The Clinic remains responsible for determining what consent, assent, representative authority, presence of a guardian, professional authorization or other safeguard is required before providing remote healthcare to a minor or person who cannot legally consent independently.

22. Conduct and Prohibited Uses

You must not use Session functionality to harass or threaten participants, impersonate another person, obtain unauthorized access, interfere with the technology, transmit malware, unlawfully record or publish private Session content, solicit unlawful healthcare services, or use GetClinic for conduct prohibited by the Patient Terms or applicable law.

GetClinic may restrict or end access to Session technology where reasonably necessary for security, abuse prevention, privacy, Patient safety, sanctions, legal compliance or material violation of applicable GetClinic terms.

23. No Guarantee of Outcome, Availability or Specific Professional

GetClinic does not guarantee that a Session will produce a diagnosis, treatment recommendation, prescription, Clinic Offer, medical approval, Treatment booking or particular clinical outcome.

Unless a transaction-specific record expressly guarantees otherwise, scheduling a Session does not guarantee that a particular named healthcare professional will remain available. If a material provider change occurs, the Clinic must handle any notice, consent, rescheduling or refund right required by applicable terms or law.

24. Support, Complaints and Session Records

For technical or GetClinic-platform issues, contact [email protected]. For medical care, clinical advice, records, prescriptions or healthcare complaints, contact the Clinic directly; GetClinic may also help route a marketplace complaint where appropriate.

GetClinic may retain records reasonably necessary to evidence Session operations and legal compliance, such as Session ID, Clinic, scheduled time, participant/account identifiers, connection events, duration/technical metadata, Session Terms version, acceptance timestamp, payment/refund records, support events and recording/transcription status where applicable. This does not mean GetClinic records the audio/video content of every Session.

Privacy requests concerning GetClinic processing may be submitted to [email protected]. Legal notices concerning GetClinic may be sent to [email protected] in accordance with the Patient Terms.

25. Changes to These Session Terms

GetClinic may update these Session Terms for future Sessions to reflect product, security, operational or legal changes. GetClinic will version the Terms and will not silently replace the text of an already accepted version. Where applicable law or the Patient Terms require notice or renewed acceptance for a material change, GetClinic will provide it.

A change does not retroactively alter the financial or clinical terms of a completed Session unless mandatory law requires otherwise or the change is more favorable to you and lawfully applied.

26. Final Allocation of Responsibility

GetClinic is responsible for the GetClinic technology and marketplace services it actually provides. The Clinic and its healthcare professionals are responsible for healthcare and for determining whether a Session is suitable and lawful for the clinical service they provide.

The fact that GetClinic schedules, hosts, transmits, records metadata for, or facilitates payment for a Session does not make GetClinic the healthcare provider, and the fact that a Session is described as non-clinical does not excuse a Clinic or professional from healthcare law if clinical care is actually provided.
